My Health My Data Privacy Policy

This My Health My Data Privacy Policy ("Washington Notice") supplements the information contained in Harbor's Privacy Policy and State Privacy Law Addendum and applies solely to individual residents of the State of Washington ("consumers" or "you").
This Notice is provided pursuant to the Washington My Health My Data Act, RCW Ch. 19.373, as amended from time to time ("MHMDA").
This Washington Notice describes your rights under the MHMDA with respect to your Consumer Health Data and explains how to exercise those rights, subject to applicable legal exceptions.
Any capitalized terms not defined in this Notice have the meanings assigned to them under the MHMDA or Harbor's Privacy Policy.
What Is Consumer Health Data?
Consumer Health Data is personal information that is linked or reasonably linkable to a consumer and that identifies past, present, or future physical or mental health status. This may include:
- Individual health conditions, treatment, diseases, or diagnosis
- Social, psychological, behavioral, and medical interventions
- Health-related surgeries or procedures
- Use or purchase of prescribed medication
- Bodily functions, vital signs, symptoms, or measurements of health information
- Diagnoses or diagnostic testing, treatment, or medication
- Gender-affirming care information
- Reproductive or sexual health information
- Biometric data
- Genetic data
- Precise location information that could reasonably indicate a consumer's attempt to acquire or receive health services or supplies
- Data that identifies a consumer seeking health care services
Categories of Consumer Health Data Collected
Harbor may collect the following categories of Consumer Health Data:
- Health conditions and medical history related to weight management and metabolic health
- Medication history and current prescriptions
- Bodily measurements such as weight, height, and BMI
- Information provided during clinical consultations
- Images or photos you upload in connection with your care
Sources of Consumer Health Data
We collect Consumer Health Data from the following sources:
- Directly from you when you complete health questionnaires, intake forms, or communicate with providers
- From licensed healthcare providers within our provider network
- From pharmacies involved in prescription fulfillment
Purposes for Collecting Consumer Health Data
We collect and use Consumer Health Data for the following purposes:
- To facilitate telehealth services and enable providers to deliver care
- To process prescription orders and coordinate pharmacy fulfillment
- To communicate with you regarding your care and treatment
- To maintain records as required by law
- To comply with legal and regulatory obligations
- To detect and prevent fraud, security incidents, and other harmful activities
Categories of Third Parties with Whom Consumer Health Data Is Shared
We may share Consumer Health Data with the following categories of third parties:
- Licensed healthcare providers who deliver care through the platform
- Pharmacies for prescription fulfillment and shipping
- Service providers that support platform operations, including hosting, security, and customer support
- Legal and regulatory authorities when required by law
Harbor does not sell Consumer Health Data.
Categories of Third Parties with Whom Consumer Health Data Is Sold
Harbor does not sell Consumer Health Data to any third parties.
Your Rights Under the MHMDA
Subject to certain exceptions, Washington residents have the following rights regarding their Consumer Health Data:
Right to Confirm and Access
You have the right to confirm whether we are collecting, sharing, or selling Consumer Health Data about you, and to access such data.
Right to Deletion
You have the right to request deletion of Consumer Health Data we have collected from you, subject to certain legal exceptions.
Right to Withdraw Consent
You have the right to withdraw consent for the collection and sharing of Consumer Health Data at any time. Withdrawal of consent will not affect the lawfulness of processing conducted prior to your withdrawal.

We may request additional information to verify your identity before processing your request. We will respond within the timeframes required by applicable law.
Authorized Agents
You may designate an authorized agent to submit a request on your behalf. We may require proof of authorization and verification of your identity before processing the request.
Right to Appeal
If we deny your request, we will provide an explanation of the reasons for the denial. You may appeal our decision by submitting an appeal request to legal@visitharbor.com.
If you have concerns regarding the outcome of an appeal, you may contact the Washington State Attorney General.
Geofencing Prohibition
Harbor does not use geofencing technology to identify or track consumers who access healthcare facilities for purposes of collecting Consumer Health Data.
