Virginia Resident Privacy Notice

This Virginia Resident Privacy Notice ("Virginia Notice") supplements the information contained in Harbor's Privacy Policy and State Privacy Law Addendum and applies solely to individual residents of the Commonwealth of Virginia ("consumers" or "you").
This Notice is provided pursuant to the Virginia Consumer Data Protection Act, Va. Code ยงยง 59.1-575 through 59.1-584, as amended from time to time ("VCDPA").
This Virginia Notice describes your rights under the VCDPA with respect to your Personal Data and explains how to exercise those rights, subject to applicable legal exceptions.
Any capitalized terms not defined in this Notice have the meanings assigned to them under the VCDPA or Harbor's Privacy Policy.
The Right to Confirm, Access, and Data Portability
You have the right to confirm whether we are processing your Personal Data and to access and obtain a copy of the Personal Data we have collected about you, subject to verification of your identity. You also have the right to obtain a copy of such Personal Data in a portable and, to the extent technically feasible, readily usable format.
The Right to Correct
You have the right to request that we correct inaccuracies in the Personal Data that we maintain about you, taking into account the nature of the Personal Data and the purposes for which it is processed.
The Right to Request Deletion
You have the right to request that we delete the Personal Data we have collected from you, subject to certain exceptions permitted by law. Once we receive and verify your request, we will delete your Personal Data from our records and direct our service providers to do the same, unless an exception applies.

We may request additional information to verify your identity and locate your Personal Data within our systems. We will use any information provided solely for the purpose of processing and responding to your request. If we are unable to verify your identity, we may be unable to fully process your request.
Response Timing and Format
We will endeavor to respond to a verifiable consumer request within 45 days of receipt. If reasonably necessary, we may extend this period once by an additional 45 days, and we will notify you of any extension and the reason for it.
If you have an account with us, we may deliver our response through your account. Otherwise, we will provide our response electronically or by other reasonable means.
Information provided in response to a request will generally be provided free of charge, up to twice per year. We may charge a reasonable fee if a request is excessive, repetitive, or manifestly unfounded, as permitted by law.
Right to Appeal
If we decline to take action on your request, we will provide an explanation of the reasons for the denial. You may appeal our decision by submitting an appeal request to legal@visitharbor.com.
We will respond to appeals within 60 days of receipt and inform you of any action taken or not taken and the reasons for our decision. If your appeal is denied, you may submit a complaint to the Virginia Attorney General.
The Right to Opt Out of Targeted Advertising, Sale of Personal Data, or Certain Profiling
You have the right to opt out of the processing of your Personal Data for purposes of:
- Targeted advertising
- The sale of Personal Data
- Profiling in furtherance of solely automated decisions that produce legal or similarly significant effects concerning you

You may designate an authorized agent to submit an opt-out request on your behalf, subject to verification requirements.
